Extra pay for extra hours?
I teach five hours more than all the other teachers at my school but
receive no extra pay. Are there any of you CDS teachers out there who
get payed for the extra minutes? If so, how did you get that to work?

Guidelines 4 behavior problems & removing students
I would like to see if anyone has a copy of guidelines for
removing a student from their CDS program. I believe, along with my
colleagues, that we need to have something in writing.
I am also interested in a set of
guidelines that deal with behavior issues including: drug
possession, being in class under the influence of a controlled
substance, drug paraphenalia, fighting, vandalism, etc...
including how you deal with other issues like attendance,
tardiness, and verbal defiance of teachers, or staff.
Any help would be well appreciated.

Uniforms
We have been using "uniforms" for about 6 years. We require purchase
of a package when kids enter, that includes sweatshirt, t-shirt, notebook
with seven dividers, vinyl pouch, and a planner. In addition to the
t-shirts, guys have to wear blue jeans. Biggest problem in the
beginning was staff consistency in enforcement.

Uniforms in CDS
We have had students wear uniforms in our community day schools, when it
enhanced the program. It was best introduced in a class by having the
students develop a logo fitting the school to career theme of the class
(like Technology Academy) that would be used on a golf polo style
shirt. We purchased the shirts with CDS funds, and students
put them on at school (rather than taking them home and losing them or not
coming to school wearing them) and used a laundry service to maintain
them. The technology academy currently has black polo shirts
with a collar.

School uniforms?
We do not allow any students to wear blue, red, or any gang
affiliated clothing. This has been a constant battle. I think
it might be a good idea to go with a "uniform look" such as jeans and a
gray or white T-shirt. Or, we could make students purchase a
"Community Day School" shirt, when they enroll. Any
suggestions?

Parent Involvement
I am trying to figure out how to get our parents more involved in our program and become pro- active in their childs education and how to change some of their behaviors. We want to have more of a partnership with our parents. A couple of years ago I attended the conference in Sacramento and heard of a school that was having required workshops that were making a difference in their school. Which Text To Use
I am wondering if community day schools have to use instructional books that are on the state approved list. I have been using AGS books as my students get lost in the verbage and clutter of the state approved math books, but these are not on the state adopted text lists and with limited funding it is difficult to have both texts in the classroom. School used as a dumping ground
I t seems that our school is being used as a dumping ground. We have not ever had curriculum books. We are asking for them with no results. Administration wants us to run this classroom like a prison, no clock, black out windows, etc, They do not believe in rehabilitation. We have never been able to get Special Education Services for our students with I.E.P.'s. Once or twice a year a Special Edcation Teacher comes over, but doesn't work with the students. I would also like to know if it is legal to leave the classroom with a paraprofessional in charge and no credentialed teacher on campus? I am afraid for my job if I say or ask adminstration too much. Any information would be appreciated.

5-6 Funding
For the second time in the last four years, it seems CDS budgets are being "deficited" (term from my finance lady). She says that 5th-8th period income will be reduced by 12%. This is for all the non "mandatorily expelled" (mandatory expulsion is basically for carrying a gun) students.
If the above is correct, this means about an 8% cut in my budget less than two months before the fiscal year is over.
I would like to know the specifics on this cut, then I would like the names of the legislators who keep messing with us. You cannot run a quality program when your budget is in constant flux. In fact, twice now we have been given a budget at the beginning of the year and later had these "deficits" removed from our budgets.
Tom: Can you please post some information for us as to who these decisionmakers are and offer some suggestions as to how we can help them understand the effects of their whims down here in the trenches?
I was hoping the first round of "deficits" was because of the budget crisis, but it looks like we may face attacks for more reductions every year unless we speak up.

The only section I found is 37060 which allows a high school district (or a union high school district ) to establish a junior high school.
Both the high school district and neighboring K-8 district are small. They feel that it would be more efficient to have a single community day school for grades 7-12, but neither district covers that span. How can this be achieved?

8th grader to 9-12 H.S. CDS?? (nm)
Hello-
Could use some help with this...
I've got an elementary dist. that would like to send one of their 8th
grade CDS students to our high school (9-12) CDS. I believe it
could be a good placement for the student but I have some questions
about how to make it happen.
1. Would an MOU or an interdistrict be best if we would rather not transport the student?
2. Would the sending dist. be in charge of the curriculum and credit assigning? (we are not
a unified dist. and have no 8th graders)
3. What is the downside of bringing an 8th grader into a high school dist.?
If you are currently doing this or know someone who is....please let me know.

Online Courses
We are currently starting a new Community Day School in the Novato Unified School District (in Marin County). The program will start in February with about fifteen students in grades 7-12.
We are seriously interested in having students take one or two on-line courses. However, the least expensive WASC accredited company we found costs $300 per student, per course.

Saturday School ADA
This is Don Eggleston, from New School in Watsonville (near Santa Cruz). We have 60+ high school students, and this year we added a 3-4pm (7th period) study hall. We have also added Saturday School. It is like any other school day, 6 hrs., certificated teacher, etc. When claiming ADA, it seems to be a problem for our district SASIXP attendance program, because the program cannot accomodate recording Saturday School attendance for only the students assigned to Saturday School (needing more help getting their work done, or needing "attitude adjustments". In other words, not all regularly enrolled students are expected to attend Saturday School. Our district attendance accountant says there is no way to record Saturday School attendance for just those assigned. Her suggestion was just to mark all those not attending (assigned or not) as absent. This would, of course, trash our ASAM, SARC, and other percent of attendance figures. Someone at the state level suggested we just mark those not assigned for Saturday as Not Enrolled. This would of course obliterate the ASAM statistics, since almost no students would be attending 90 consecutive days.
I would like to know how other CDSs are handling Saturday School ADA.

Answer to Extended Year Attendance
With community day schools, there is no such thing as summer school. There are only school days. The Education Code does not specify a minimum or maximum number of days CDSs may operate within a school year.
Section 48664(b) instead provides that the average daily attendance of a CDS is to be determined by dividing the total number of days of attendance in all full school months by a divisor of 70 in the first period of each fiscal (school) year, by a divisor of 135 in the second period of each fiscal year, and by a divisor of 180 at the annual attendance reporting time for each fiscal year.
Section 48666 permits school districts to establish CDS attendance policies that require students to attend school for up to seven days each week. Such requirements may be implemented when this action is taken as part of a directed program designed to provide the students with the skills and attitudes necessary for success when they return to a regular school environment. School districts also have the option of operating CDS longer than the districts' normal school year, including year-round.
Usually, a.d.a. is calculated by dividing the total number of student days of attendance in a specified period of months by the number of days school was in session during those months. Specified "fixed divisors", which are substituted in a.d.a. calculations for the number of days schools were in session, automatically increase funding credit proportionally for each additional day of instruction beyond the number in the divisor or, conversely, automatically reduce funding credit proportionally for each day by which the number of days of instruction is smaller than the divisor

Behavior Issues
I have a 4-6 CDS and am looking for resources (articles, websites, etc.) on working with students who tend to temper tantrum. I am seeing at least 3 of my boys acting like spoiled, overendulged kids. I suspect that the parents have become afraid of their reactions to discipline and simply give in to their requests, but of course that leaves the school to clean up the mess. For example, a 7th grade aged student was upset that his breakfast was soggy. When he didn't get a new breakfast immediately, he proceeded to throw his food, damage an art project and pound on the wall. Yesterday, a student needed to staff attention. When staff asked him to hold on a minute as she was assisting another student who was having a difficult time, he threw a temper tantrum; throwing a drink, a chair and screaming. These boys have lots of issues, and being impulsive is certainly one of them. However, I am seeing more overendulged, self centered students who demand attention. Anybody else have these issues?

Can after school tutorial time be used to back fill excused absences for students? I will rephrase. If a student has an excused absence, can they make up the time that they missed in an afterschool tutorial similar to the comprehensive schools where they use tutorials and Saturday school to do this?

Extended year attendance
We have an extended year program in our CDS's and the teachers are asking me whether they can legally require students to attend. It runs the length of what summer school is for the rest of the District but they run an entire school day as opposed to a minimum summer school day. They want to know that if they can legally require it (maybe as part of the expulsion contract), and what they can do if a student/parent refuses. Any ideas?

Answer: P/NP grades
We use letter grades because of the Grade Point Average (GPA) calculations. P/NP are often calculated as a "C" level in GPAs. This may effectively lower a student's overall GPA. Students in our Community Day Schools have used their overall GPA to apply for college, scholarships, admissions to post-secondary vocational schools, and to the Military.

Answer to Class Size and Costs
Education Code Section 48660.1 states the Legislature's intent that
community day schools have a "low pupil-teacher ratio" and "individualized instruction and assessment." Our understanding is that this means that class size should be maintained at a level where the teacher knows the needs, strengths, and developmental levels of each student - in terms of academic, social, and emotional development. While it is appropriate and beneficial to do some group instruction and to have students learn to work collaboratively in groups, the accepted guideline is that when the number of students necessitates teaching to "the class" rather than clearly seeing each student and designing the instruction based on the needs of each student, then there are too many students in the class.
One indicator of the appropriate class size is the average daily
absence rate (as compared to average daily attendance). While many factors combine to impact student attendance, class size can have a significant impact. When at-risk students cannot receive the individual attention they need (and may be overwhelmed by the sheer numbers of a large class), they often "vote with their feet" and are absent. Past a certain point, as enrollment goes up, the average number of students attending each day may stay approximately the same. You simply have more students absent each day. There is no magic number for the maximum number of students. Certainly this depends on the range of ages and needs of the students, the skills, experience, and empathy of the teacher, the amount of support services and personnel involved, etc. However, practitioners often
state that any enrollment above 15 (and 10 for elementary students) at least begins to raise questions about the ability to fully deliver services.
You ask about cost-benefit analysis. The key point is that funding is provided based on average daily attendence - that students who are absent represent significant amounts of lost funds. Combined base and supplemental funding is greater than $9,000 per unit of average daily attendance. Districts have found that by hiring an additional, high quality teacher, and assigning this teacher to an additional classroom to reduce the class size in other classes, the absenteeism rate often goes down. The fiscal point is that the money regained by the improved attendance may go far towards the cost of the additional teacher - and the students are in school, working on their academic and social-emotional development.
As mentioned above, teacher qualities are extremely important with
high-risk students. Your question re mid-year hiring when classes fill up vs hiring at the beginning of the year in anticipation of increasing enrollment raises the issue of the likelihood of finding the right person. Again, some districts have found that higher attendance rates reflecting having strong teachers working with fewer students can make up part or even all of the cost differential of having an "extra" teacher from the beginning of the school year.

Teasing and rewards
I run a fairly new and isolated, very small (2-3) CDS for mostly 7th-8th graders. We're rural and just down the road from the Jr. High. The kids HATE that they can't get together with other kids and are teased a lot. So, I have two questions. 1). How do I change the feeling that the CDS is "for retards"? (their words) It really keeps kids from joining us who might want to. 2). What do small programs have in place that is wporking for rewards? I'm looking for ideas.

Choice Theory by William Glasser
New School, in Watsonville, has been in operation for 14 years now. Our enrollment is 60 9-12th graders. For the last couple of years our staff has been studying Dr. William Glasser's ideas about human psychology called Reality Therapy and Choice Theory.
It's really simple: eliminate coercion; that means rewards and punishment. Sounds impossible with our clientele, but we are getting closer and closer to using little coercion. When a student "flames out" in class, s/he goes to the Counselor of the Day and fills out a Reality Check form. The form asks why the student is at New School (to get a diploma), why s/he got sent out, and if what s/he did was moving him/her closer to the diploma. Then, what could the student do differently. This puts the student in charge of his/her life, which is critical for our kids. We don't do victimhood. This philosophy is totally non-adversarial, and puts the staff in the position of being a coach rather than a taskmaster.

Counseling Services
We have a 9-12 Community Day School in Watsonville, near Santa Cruz. For many years (we're 11 years old), I tried to "break in" to the County Mental Health system to get my kids some quality services--something beyond the $8/hour recovering addict many agencies offer.
One of my student's parents happened to work for our County Supervisor. We met, he sent a MediCal eligibility worker out to screen my kids, and we now have THREE qualified full-time counselors. The match we pay is now about $9,000 each. (The first one was $5800.) All you need is ten full-scope MediCal students.The counselors have to do at least one full day a week of onerous paperwork, but that still leaves plenty of time for individual sessions and lots of group work.

Mandatory Expulsions - Clarification and Correction
Expulsion laws are complicated and can be
confusing. Education Code Section 48915 provides
for conditions under which a student shall, can,
or shall not be
expelled, depending on the offense. These conditions are
important to keep in mind, and adhere to, when also looking at
Education Code
Section 48900, which states that a pupil may not be suspended from
school or recommended for expulsion unless the
superintendent or the principal of the school in which the pupil is
enrolled determines that the pupil has committed any of a listed of
specified acts. Unfortunately, the groupings between offenses between the
two EC sections are not perfectly aligned - for example, possessing or
selling drugs are together in one paragraph in Section 48900, but are
listed and treated separately and differently according to two paragraphs
in Section 48915.
Mandatory expulsions are only for the five offenses listed in
Education Code Section 48915 (c), which reads as follows:
48915.(c) The principal or superintendent of schools shall immediately
suspend, pursuant to Section 48911, and shall recommend expulsion of a
pupil that he or she determines has committed any of the following acts at
school or at a school activity off school grounds:
(1) Possessing, selling, or otherwise furnishing a firearm.
This subdivision does not apply to an act of possessing a firearm if the
pupil had obtained prior written permission to possess the firearm from a
certificated school employee, which is concurred in by the principal or the
designee of the principal. This subdivision applies to an act of possessing
a firearm only if the possession is verified by an employee of a school
district.
(2) Brandishing a knife at another
person.
(3) Unlawfully selling a controlled
substance listed in Chapter 2 (commencing with Section 11053) of Division
10 of the Health and Safety Code.
(4) Committing or
attempting to commit a sexual assault as defined in subdivision (n) of
Section 48900 or committing a sexual battery as defined in subdivision (n)
of Section 48900.
(5) Possession of an
explosive.
While some districts have local policies requiring expulsion for
offenses listed under Education Code Section 48915 (a), expulsion for
these offenses is not mandatory under the law. Section 48915 (a) reads as
follows:
48915. (a) Except as
provided in subdivisions (c) and (e), the principal or the superintendent
of schools shall recommend the expulsion of a pupil for any of the
following acts committed at school or at a school activity off school
grounds, unless the principal or superintendent finds that expulsion is
inappropriate, due to the particular circumstance:
(1) Causing serious physical injury to another person, except in
self-defense.
(2) Possession of any knife or other
dangerous object of no reasonable use to the pupil.
(3) Unlawful possession of any controlled substance listed in Chapter 2

Mandatory Expulsions
This is our first year with our own CDS and I just need
clafication to make sure we are understanding the Ed
Code correctly.
"Mandatory
Expulsions" can only be the students who violate Ed Codes 48915A or
48915C and are expelled?
Example: We have a student who has
been expelled the last two years. This school year he brought
marijuana (less than an ounce) to school and tried to sell it. He was
suspended under 48900(c), (d) and (k) and we are recommending expulsion for
this student. If expelled, this student can not be catergorized as
"Mandatory" correct?
(We are so glad we now have our own CDS
so hopefully this student will have better success!)

Response re 7th and 8th Hours
You are correct. We pay for the 7th and 8th hours of the student's day - not the school day.
In your example, on the day in question, the 3rd hour of the school day would be the 1st hour of that student's day. We total the number of hours the student attended. If the total hits 7 or 8, they qualify for additional funding.
Of course, this is the same way we calculate attendance of the 5th and 6th hours - they refer to the number of hours the student attended, not the number of hours the school was operating.
Also (and I hope this is obvious), an hour in the middle of the day that the student is away from school does not count towards the total number of hours attended that day.

A question has come up from one of the districts that we audit regarding the reporting of 7th and 8th hours of attendance for community day school. My understanding is that the student must have attended the full 360 minutes before being able to claim the 7th and 8th hours. For example, if the student does not show up at school until the 3rd hour then the student will not qualify for the funding even if the student stays at school for the 7th and 8th hours. Attendance Reporting

I am looking for information on software to help streamline our CDS attendance reporting.
Currently, we have to “tally” by hand, the 5th and 6th period’s attendance numbers using daily attendance logs.
This allows room for error.
Is anyone using a particular software that is well suited for generating such reports?
We are managing
40-50 records each attendance period and spending a lot of time doing it.

Extra Duties
Hi I am new to CDS and my district wants me to also be in charge of
Homestudy students at our regular school site. This would require me to
meet with each parent for one hour per week, take attendance, arrange for
music, computer, PE participation with regular classes and advise on

The teachers in my district teach 300 instructional minutes. I teach 360 instructional minutes.
The teachers in my district get a minimum of 30 minutes of lunch break (a maximum of 45 minutes), and may leave their campus at will to walk next door for lunch. I get a maximum of 30 minutes for lunch, and have to ask permission to leave campus (so, in order to go to the local sandwhich shop, I drive 10 minutes, order in 10 minutes, and can enjoy a 10 minute lunch on my drive back).
The teachers in my district have early release days every other Friday for staff inservices, team meetings, and other activities which may be used as part of their 150 clock hours for credential renewals. I am not allowed to attend, because of the 360 minute instructional time requirements.
Now, a colleague of mine in the neighboring district earns a 6/5 salary, because his district pays him to work 6 hours, while the other teachers in his disctict work only 5. Perhaps his association has an enforcable contract, with something called "binding arbitration". We've only recently discovered that term, and my association bargained it away for a 2% raise.

Certificated Coverage
I have a real concern with a district that hires an aide to cover a class for duty free lunch and prep time. If I leave the school for lunch or for prep time the adminstration says it is legal for an aide (non certificated) to cover the class. Yet I am rarely allowed to leave the classroom for these times without approval. What can be done about this? I don't get the extra pay for teaching during prep times as others in the district do.

It is my understanding that 90% of the dollars generated by a CDS must go back to the actual site that generated the $$. Where can I find a simple explanation as to what can be charged against the 90% by the LEA? Are there strict guidelines regarding the 90%?
